DEADLINE AND PLACE OF DELIVERY
GIGABYTESERVER.ES will deliver the product in perfect condition to the address indicated by the Customer in the "Shipping Information" form.
Orders received before 6:00 p.m. will be processed and shipped the same day if their availability allows it, the customer receiving them within 7/12 business days (anywhere on the peninsula). Delivery times may be extended in exceptional circumstances, in which case the different existing options will be communicated to the customer. At the time of departure of the order from the place of origin, you will receive a locator code with which you can, through the corresponding carrier's website, know the status of your shipment.
The delivery time for orders to the Balearic Islands can range between 10 and 15 business days depending on the date the order was placed, the state of the sea and the weight / volume of the package.
The delivery time for orders for the Canary Islands can range between 15 and 22 business days depending on the date the order was placed and the state of the sea.
The delivery time for orders to Ceuta and Melilla can range between 10 and 14 business days depending on the date the order is placed.
GIGABYTESERVER.ES considers the confirmation of payment, by any of the indicated systems, a necessary condition to be able to maintain these delivery times. However, these deadlines are an estimate and may vary for logistical reasons or force majeure. In case of delays, the Client will be informed promptly.
It is possible that the same order is divided into several deliveries. If this is the case, each delivery will be billed separately and payment will also be made separately according to the product delivered.
Once the transport company makes the requested product available to the client, it will be understood that it has been delivered.
The customer has the right to cancel the purchase made when, for attributable reasons, GIGABYTESERVER.ES makes a late delivery. To do this, the customer must follow the instructions described in the "Exchanges and Returns" section. In the event that the order is made available to the client by the transport company within the agreed period and cannot be delivered due to causes attributable to the client, it cannot be considered a delay.
If at the time of delivery the Customer is absent, the carrier will return to the indicated address up to two (2) more times at different times to be able to make the delivery. In the event that you cannot be found, GIGABYTESERVER.ES will contact you to arrange a new delivery date and time.
When seven (7-10) business days have elapsed from the delivery of the order, and delivery has not been arranged, the Customer must contact GIGABYTESERVER.ES If he does not do so, when ten (14) business days have elapsed since the delivery of the order, it will be returned to its place of origin of GIGABYTESERVER.ES In this case, the Customer must bear all the shipping and return costs of the merchandise.
The user will be able to indicate the delivery time that best suits their needs. The chosen schedule must contain a minimum time slot of 4 hours (eg from 10 a.m. to 2 p.m.) and must be within working hours. Orders will not be delivered on weekends or holidays. On some occasions, due to the route carried out by carriers, it is difficult to satisfy the needs of all customers. For this reason, it is advisable to request the delivery of the order in places where you can receive the package during the longest possible time slot. In case of having difficulties to receive the package yourself, it is advisable to find a friend, relative, neighbor, etc. that can facilitate the delivery of the same. In any case, in case of problems at the reception, we will try to deliver the package up to three times before proceeding with its return.
DELIVERY STATUS OF THE PRODUCTS PURCHASED - DAMAGE IN SHIPPING
The Customer must check the good condition of the package before the carrier that, on behalf of GIGABYTESERVER.ES, delivers the requested product, indicating on the delivery note any anomaly that may be detected in the packaging. Reject the product and mark “damaged material” on the delivery note. If, subsequently, once the product has been reviewed, the Client detects any incident such as hit, breakage, signs of having been opened or any damage caused to it by the shipment, the Client undertakes to notify GIGABYTESERVER.ES in writing in the shortest term. possible time and in a maximum of seven (7) business days from delivery.
CANCELLATION OF ORDERS
GIGABYTESERVER.ES acts as a distributor of manufacturers or wholesale distributors, under the legally established terms, for a period of 3 years from the delivery date. GIGABYTESERVER.ES, informs that the contractual guarantee offered is the one specified by the supplier or its manufacturer, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for Defense of Consumers and Users. The duration of these guarantees is clearly detailed in the product description sheet.
The warranty does not include deficiencies caused by negligence, blows, use or improper handling, unsuitable voltage, electrical accidents, installation and / or non-conforming use not carried out by the authorized Technical Service when appropriate, or materials subject to wear due to normal use . Products modified or repaired by the customer or any other person not authorized by the manufacturer or supplier are excluded from the guarantee. The warranty will not be applicable to apparent defects and product conformity defects, for which any claim must be made by the customer in question within seven (7) days after delivery of the products.
The guarantee loses its value:
a) if any of the data of the same or of the proof of purchase are modified, altered or replaced.
b) if both the identification number and the guaranteed product are manipulated or repaired without the knowledge of the Technical Service or the company responsible for the guarantee.
c) If you lack the receipt or delivery note of purchase and delivery of GIGABYTESERVER.ES
To make use of the guarantee, it is essential to present the guarantee certificate together with the receipt or delivery note from GIGABYTESERVER.ES

In the event that any clause of these GTCs is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the very purpose of these GTCS.
GIGABYTESERVER.ES reserves the right not to exercise any of the rights and powers conferred in these Terms and Conditions. This power will not imply in any case the waiver of them unless expressly recognized by GIGABYTESERVER.ES or prescription of the action that in each case corresponds.
The parties, expressly waiving their own jurisdictional jurisdiction, submit, in case of litigation, to the jurisdiction of the Courts of the city of Madrid.
